Terms and conditions
1. Purpose
1.1. These General Terms and Conditions of Sale (T&Cs) apply to all services provided by YAV Creative Design, regardless of the selected package.
1.2. They define the respective rights and obligations of YAV Creative Design and the Client.
2. Orders and Quotes
2.1. All services are subject to a personalized quote, valid for 30 days from the date of issue.
2.2. The order is confirmed upon written approval of the quote (via signature or email confirmation) and/or payment of the deposit.
2.3. The quote specifies the elements included in the service, as well as an estimated project timeline.
3. Services
3.1. Services are personalized based on the Client’s expressed needs.
3.2. They may include: visual design, interior layout advice, 2D/3D planning, site assistance, or specific services for professionals.
3.3. The scope of work is detailed in the approved quote. Any service not listed will require separate agreement and billing.
4. Pricing and Payment Terms
4.1. All prices are in euros, excluding VAT.
4.2. A minimum deposit of 30% is required to confirm any order.
4.3. The balance is payable upon receipt of the invoice, within a maximum of 30 days unless otherwise stated.
4.4. Late payments will incur penalties according to the legal rates in force.
5. Deadlines
5.1. Deadlines are provided as an estimate.
5.2. Any delay shall not be grounds for cancellation or claims, unless expressly stipulated in the contract.
6. Modifications
6.1. Unless otherwise agreed, up to three rounds of revisions are included in the service.
6.2. Additional changes will be billed separately according to current rates.
7. Deliverables
7.1. Deliverables are provided digitally (PDF, JPG, PNG, and source files where applicable).
7.2. No physical materials will be delivered unless otherwise agreed upon by both parties.
8. Intellectual Property
8.1. Intellectual property rights are transferred to the Client only after full payment.
8.2. Until full payment is received, YAV Creative Design retains exclusive ownership of the deliverables.
8.3. Any unauthorized reuse, reproduction, or modification is strictly prohibited.
9. Liability
9.1. YAV Creative Design is bound by a best-efforts obligation and commits to carrying out the work professionally.
9.2. Liability is limited to the total amount invoiced for the specific project.
9.3. Under no circumstances can YAV Creative Design be held liable for indirect damages, loss of business, or disputes between the Client and third parties.
10. Confidentiality
10.1. All information exchanged between the parties is strictly confidential.
10.2. No disclosure may be made without prior written consent from the other party.
11. Force majeure
11.1. Neither party shall be held liable for non-performance of the contract due to events of force majeure that make total or partial execution impossible.
12. Applicable Law and Jurisdiction
12.1. These T&Cs are governed by Belgian law.
12.2. In case of dispute, and failing an amicable resolution, exclusive jurisdiction is granted to the courts of Brussels.
13. Acceptance
13.1. Any approval of a quote or start of work constitutes full acceptance of these Terms and Conditions.
14. Site Follow-up (Support Package)
14.1. When the chosen package includes site support, YAV Creative Design acts in an aesthetic and functional advisory role.
14.2. This includes occasional site visits, communication with contractors, and checking alignment with the design.
14.3. YAV Creative Design does not sign contracts with contractors; the Client remains solely contractually bound to them.
14.4. In case of poor workmanship, delays, or disputes, the Client is responsible for resolving the matter with the service providers.
14.5. The role of YAV Creative Design is visual and consultative only and does not include technical supervision or legal project management.
15. Professional Services (Pro Package)
15.1. For collaborations with professionals (agencies, firms, companies), each project is defined individually.
15.2. Services may include: visual concepts, spatial branding, presentation support, or creative direction assistance.
15.3. The professional partner is responsible for regulatory compliance, technical validation, and usage of the materials produced.
15.4. YAV Creative Design shall not be held responsible for decisions or uses made beyond the contractual scope.
16. Contract Termination
The Client may terminate the contract at any time, in writing (by email or registered letter).
- The deposit remains acquired by YAV Creative Design as compensation.
- Work already carried out will be billed proportionally.
- No refund will be made for services already started, delivered, or scheduled.
16.2. Termination by YAV Creative Design
YAV Creative Design reserves the right to terminate the contract in the event of:
- non-payment or late payment,
- lack of feedback or collaboration that prevents progress,
- inappropriate or disrespectful behavior from the Client,
- serious breach of contract.
In such cases:
- The Client will be notified in writing.
- Work already completed remains payable.
- The deposit remains with the Provider.
16.3. Termination due to Force Majeure
In case of force majeure (illness, accident, technical failure, or unforeseen external events), either party may terminate the contract without compensation.
Work completed up to the termination date will be invoiced and must be paid.
